Refund & Cancellation Policy

This Refund & Cancellation Policy (the "Policy") forms part of the Terms of Use and the Subscription & Payment Terms. By taking out a paid Subscription, you agree to this Policy. The Policy is drafted clearly and fairly and does not limit your non-waivable rights under mandatory Israeli law.
1. Definition of the service — what you receive
1.1. The service is the generation and publication of marketing content. Mitkadem generates marketing and advertising content according to the parameters you set (niche, target audience, brand style, budget, schedule) and publishes it to your Connected Channels (social networks and advertising systems).
1.2. Delivery of the service = performance of the obligation. The very act of generating the content and publishing it to your Connected Channels constitutes performance of the Operator's obligation to you. Once the Service has generated and published content for you in a given billing period, the obligation for that period has been fulfilled.
2. Commercial result — not guaranteed
2.1. What is not guaranteed. Reach, engagement, the number and quality of leads, audience response, client conversion, sales, and any other commercial result depend on many external factors — the market, your pricing, demand, competition, the quality of your own response to clients, platform policies (Meta and others), and the budget you allocate. These factors are outside the Operator's control.
2.2. The absence of a result is not grounds for a refund. The absence of a desired commercial result is not grounds for a refund, because the service — the generation and publication of content — was in fact delivered. The Operator does not guarantee the receipt of leads, appointments, revenue, or any campaign metric, and does not warrant any result.
3. Preservation of your statutory right of cancellation (§14ז)
3.1. The Policy does not override the law. This Policy does not derogate from a consumer's right to cancel a transaction under Section 14ז of the Consumer Protection Law, 1981 and applicable mandatory Israeli law. In the cases provided for by law, you are entitled to cancel the transaction and to receive a refund in accordance with the terms of the law.
3.2. Priority of mandatory law. If mandatory law grants you a right to a refund or a "cooling-off period" right applicable in the circumstances, that right prevails over any other provision of this Policy, and the Policy is interpreted in accordance with it.
4. Cancelling the subscription — how it works
4.1. Cancellation by you, at any time. You may cancel the Subscription at any time. Cancellation takes effect at the end of the current billing period, so you do not pay for the following period.
4.2. How to cancel. Initiate cancellation through the dashboard (where available) or send a request to mitkadem.com@gmail.com from the email address registered to your account. We will confirm receipt of the request and process it within a reasonable time.
4.3. Recurring charge (הוראת קבע). Upon cancellation, the recurring charge is not renewed for the following period. After the end of the current billing period, no further payment will be charged.
4.4. No refund for a partial period. Once a billing period has begun and the Service has been provided for that period, the monthly fee for that period is non-refundable — except where Section 14ז of the Consumer Protection Law or another mandatory provision requires otherwise (see Section 3).
4.5. Consequences of cancellation. From the effective date of cancellation: (a) publication of new content and lead-bot replies cease; (b) active advertising campaigns are paused; (c) account data is retained in accordance with the Privacy Policy, unless you separately request deletion.
5. Advertising budget — separate from the subscription
5.1. When the Service runs campaigns on Meta (Facebook / Instagram) on your behalf, the advertising budget itself flows directly from you to Meta, bypassing the Operator, and is not included in the Subscription fee. Amounts charged by Meta are not refundable by the Operator; any billing dispute with Meta is between you and Meta.
5.2. The Operator does not charge any markup or commission on the advertising budget. The Subscription fee is the only amount payable to the Operator for the Service.
6. Failed payments
If a renewal payment fails (for example, an expired card or a declined payment), the Operator will attempt to notify you and to retry within a reasonable time. If the renewal still does not go through, the Subscription enters a suspended state — Service operations are paused and account data is retained. No penalty or fee is charged for an ordinary reactivation.
7. Payment data
Card data is processed by the PayPlus acquirer and is not stored by the Operator. The Operator retains only the transaction records required for accounting and compliance (receipts, amounts, dates).
